What does it mean when a person is in “arrears” or “owes arrears” in the context of Family Law? A payor is “in arrears” when they are behind in the discharging or payment of a debt or obligation. In Family Law, this typically is when a payor of child support has fallen behind on such payments. A past due payment of child support is referred to as child support arrears.
Under California law, each parent has an equal obligation to support their children according to his or her ability. Accordingly when child support is ordered by the court, it must be paid. The collecting parent has the right to receive such payments for the benefit of the children. Thus any missed payments or arrears are still owed to the collecting parent, with the accumulation of interest.
