Mediation is a dispute resolution process whereby a neutral 3rd party attempts to help the disputing parties reach a mutually agreeable solution.  The neutral 3rd party is called the “mediator” and their job is to assist negotiations and communication between the parties.

In child custody matters, parties who are attempting to establish child custody and visitation orders are required to attend a form of mediation. Family Code Section 3170 makes child custody mediation mandatory. Parties can either choose to pay for private mediation or can attend court appointed mediation at Family Court Services. Family Court Services is a public agency with specially trained mediators who work with clients to resolve child custody issues. The mediation provides both parents an opportunity to speak with a trained mediator on a confidential basis and express their concerns and desires. The mediator will work with the parties to facilitate a parenting plan that is in the best interests of the child.
