No Fault Divorce

California is a “no fault” divorce state. This means that married spouses may obtain a divorce or legal separation with out proving fault. Thus a party seeking a divorce does not need to prove the marriage has ended due to the “fault” or wrong doing of one of the parties, such as infidelity or dishonesty.
Parties may obtain a divorce upon showing of irreconcilable differences arising between the parties.
